Terms of Service

These Terms of Service ("Terms") govern your use of the SB Coast Digital website and the website development, hosting, and support services we provide ("Services"). By contacting us, submitting a form, or entering into a service agreement, you agree to these Terms.

Services we provide

SB Coast Digital provides static website development, hosting, and ongoing support for small businesses on a prepaid-term basis. Services are described on our website and in your written service agreement or proposal. We specialize in brochure-style sites for service businesses — with simple payment integration (hosted payment links such as Stripe, PayPal, Square, or similar for services, deposits, or packages — your merchant account). Full e-commerce stores, user login systems, or custom web applications are not included unless separately quoted.

Every plan includes hosting and ongoing support. Managed includes one-time launch setup: Google Analytics 4, Google Search Console, sitemap submission, and basic on-page SEO (titles and descriptions), configured in your Google accounts where applicable. Lite focuses on hosting a site you already have. We do not guarantee specific search rankings or traffic results.

Plans, pricing, and billing

  • Each plan is available in prepaid commitment lengths (1, 3, 6, or 12 months), as shown on our Plans page. The full amount for your selected term is due before work begins.
  • Effective monthly rates depend on your selected plan and commitment length. Managed includes a custom launch build with no separate build fee in addition to your prepaid term. Lite covers hosting and support for a site you already have.
  • Promotional offers apply only when stated in writing at signup.
  • When your prepaid term ends, you may renew at the then-current rate for another term or choose not to renew. The monthly option is prepaid one month at a time and renews each month unless you cancel.
  • Refunds before work begins: If you cancel before we begin work on your account, we will refund your full prepaid amount. For Managed, work begins when we start design or development after reviewing your completed onboarding questionnaire. For Lite, work begins when we start hosting setup or migration after reviewing your completed onboarding questionnaire. Prepaid fees are non-refundable once work has begun, except where required by law.
  • Payment is due according to the schedule in your agreement. We may pause work or take sites offline for overdue accounts after reasonable notice.

Included monthly updates and extra work

Managed includes monthly content updates; Lite is hosting and support only: Lite: hosting and support only — content changes quoted as needed. Managed: monthly content updates included — swap photos, update pricing, refresh offers, and keep hours and CTAs current. Managed includes 2 hours of content updates per month. Unused hours do not roll over. Most small changes are quick — a typo often takes about a minute, and adding or swapping a photo usually takes a few minutes. Bigger changes take longer, but one normal request will not use up your whole monthly allowance. (Managed: 2 hours/month.) On Managed, included updates do not have to go unused. Mid-month we can check in with a few one-click options (swap a photo, update hours, refresh a CTA), and you can pre-approve a small improvement backlog — speed polish, SEO basics, link/form checks — so we keep improving your site even when you have not sent a request. Work beyond your plan is billed at $65 per hour only after you approve the estimate. Larger projects — seasonal campaigns, blog posts, new pages, rebrands, or complex integrations — are quoted separately before work begins.

Optional add-ons

The following are available on any plan, in addition to your prepaid plan fee. We quote add-ons before you pay — nothing is added without your approval.

  • Domain registration: If you do not already own a domain, we can help you choose a name and register it in your business name. $25 one-time setup fee, plus the annual registrar fee at cost (typically $12–20/year). The domain remains yours.

Build timeline

Managed sites typically launch within 1–2 weeks once we have your questionnaire and content — and sometimes sooner when your content is ready and the scope is straightforward. Starting from a layout you pick often helps — not the months-long wait common with agencies. Timelines depend on how quickly you provide content, feedback, and approvals. Complex custom work outside a standard layout may take longer and is agreed in writing before we begin.

Turnaround times

Clients submit update requests through our update form. Once we review your request, most updates are done within about an hour. If something needs more time, we'll tell you up front. Larger changes — such as a new page — may take longer and are agreed in writing before work starts.

Your responsibilities

  • Provide accurate business information, content, and feedback in a timely manner.
  • Ensure you have rights to any logos, photos, and copy you supply.
  • Maintain access to your domain registrar and any third-party accounts we need to complete work.
  • Use the website and our Services lawfully and in good faith.

Indemnification

You agree to indemnify and hold SB Coast Digital harmless from any claims, damages, or expenses (including reasonable attorney's fees) arising from content you provide (including logos, photos, and copy) that infringes a third party's rights, or from your breach of these Terms.

Ownership, buy-out, and access

Your business name, domain (when registered in your name), content, and brand assets remain yours. Google Analytics and Google Search Console are configured in your Google accounts and remain yours during and after your prepaid term.

For Managed, the custom website we build for you is part of our managed service while your prepaid term is active. After 12 consecutive months of paid Managed service, you may request ownership of that website’s files at no buy-out fee (a 12-month prepaid term counts; consecutive shorter terms that add up to 12 months also count). If you leave before that, you may buy out the site for a flat $999 — we provide an export of your site files after payment. Buy-out and vested ownership cover your customized site files as delivered; they do not include our reusable starting layouts as a product, internal tools, or third-party services. Hosting and support end when your paid term ends unless you renew or we agree otherwise in writing.

For Lite, you supply the site we host. You retain ownership of those files; Lite does not require a site buy-out.

While your prepaid term is active, we host and maintain your website. The hosted site stays live only while your prepaid term is active and your account is in good standing, unless you have completed a buy-out or vested ownership handoff and arranged hosting elsewhere.

Our commitment during your term

We know prepaying months in advance requires trust. Here's our commitment: as long as your account is in good standing (payments current and no breach of these Terms on your part), we will not discontinue hosting or support before your prepaid term ends. If we are ever unable to continue the Services during an active prepaid term for reasons within our control, we will refund the pro-rated unused portion of your prepaid term. This is separate from — and does not limit — your rights under "Refunds before work begins" above.

Cancellation

When work begins: For Managed, work begins when we start design or development after reviewing your completed onboarding questionnaire (or after we confirm your project is a fit in writing). For Lite, work begins when we start hosting setup or migration after reviewing your completed onboarding questionnaire.

Monthly plan: You may cancel at any time before your next renewal. Cancellation takes effect at the end of your current billing period — your site stays live through the month you already paid for, and you will not be charged again. There is no refund for the current prepaid month.

Prepaid terms (3, 6, or 12 months): If you cancel before work begins (as defined above), we will refund your full prepaid amount. Once work has begun, prepaid fees are non-refundable; hosting and support continue through the end of your paid term even if you ask to cancel early. There is no pro-rata refund for unused time after work has started.

At the end of your prepaid term: You may renew for another term at the then-current rate or simply choose not to renew.

When your service ends, hosting and support end on the last day of your paid term (or the end of your current billing period for monthly plans) and the site will go offline unless you have completed a vested ownership or buy-out handoff and arranged hosting elsewhere. You retain your domain, content, and Google Analytics / Search Console data.

Limitations

Except as expressly stated in these Terms or your written service agreement, the Services are provided "as is" and "as available," without warranties of any kind, whether express or implied.

  • We do not guarantee specific search rankings, traffic, or revenue results.
  • We are not liable for outages or issues caused by third-party providers (registrars, hosting platforms, form services, payment processors, etc.).
  • Our total liability for any claim related to the Services is limited to the fees you paid us in the three months before the claim arose, except where law requires otherwise. This limitation does not apply to the refund described in "Our commitment during your term" above.

Force majeure

We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, internet or power outages, third-party provider outages, acts of government, or other events of force majeure.

Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes arising from these Terms or our Services will be resolved in the state or federal courts located in Santa Barbara County, California, and you consent to jurisdiction there.

Text messaging and consent

If you provide your phone number and opt in to receive text messages from us, we use that consent solely to communicate with you about your project, account, and support requests. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the current version. Material changes will be posted on this page. Continued use of our Services after changes constitutes acceptance of the updated Terms.
